Franchise Law
Franchising has evolved into one of the most important sources of economic growth in Canada and around the world today. It is estimated that Canadian franchised businesses generate over $100 billion in sales annually, equivalent to 40 cents of every retail dollar.
The franchisor – franchisee relationship has been compared to a marriage. When it works, it can be advantageous to both parties. Like a marriage, the relationship must be built on a firm foundation. Since the franchise relationship is based largely on the contracts signed by the parties, it is important that the parties understand them and that the documents reflect the roles and responsibilities of the parties accurately and effectively.
Franchise Agreements are usually lengthy and can be difficult to understand, even by sophisticated and experienced business people. If you are contemplating investing in a franchise, it is advisable to seek expert assistance, so that you gain an understanding of the legal documents you will be asked to sign.
If you own a business that has the potential to grow into a multi-unit chain, you might consider franchising. It is important to design the program and structure the documents so that you accomplish your business objectives and protect the value of your system. Again, it is advisable to seek expert assistance.
